Article 147 of the Belgian constitution
Under Article 608 of the Judicial Code, the Court of Cassation reviews decisions made in final instance that are submitted to it for breach of the law or for violation of either substantial or procedural formalities under penalty of nullity. While lower courts are tasked with applying the rule of law to the facts presented by the parties, the Court of Cassation examines the appealed decision made in final instance: Is it properly reasoned? Is it in accordance with the law? Does it correctly apply and interpret the rule of law? Does it respect the scope of an act that was subject to judicial review?
